Most cases that go to a hearing involve the nature and extent of disability. As noted previously, a claimant may seek temporary disability benefits for inability to return to one’s employment due to the injury. Testimony from the claimant and possibly other witnesses, along with medical reports form the basis that the Administrative Law Judge/Commissioner will be use to make a decision. Treating physicians will give opinions with regard to whether the claimant is able to return to work, and if not, the medical reasons for not returning. The employer/insurance company usually will have the claimant examined by doctors of their choosing who will give an opinion as to the medical condition and why the claimant is able to return to work. For permanent partial disability claims, the treating doctor or a doctor selected by the claimant or the claimant’s attorney will give a percentage disability of the particular body part having a permanent injury. On the other hand, the employer/insurance company will also obtain a permanent partial disability rating in percentage terms which is almost always lower than the claimant’s doctor’s rating.
